The district of Minnesota denied Miner Ltd.’s motion for a preliminary injunction in this trade secrets misappropriation and breach of contract action against a former employee, on the grounds that it failed to show how it would suffer irreparable harm absent injunctive relief. The court found that Minnesota’s presumption of irreparable harm arising from a parties’ breach of a restrictive covenant was a procedural doctrine that only applied to Minnesota state courts. And the court said that the harms presented by Miner weren’t so great and imminent that injunctive relief was necessary.
