Case: Trade Secrets/Injunctions (2d Cir.)

The Second Circuit affirmed a federal district court in New York’s grant of a preliminary injunction for Hercules Pharmaceuticals Inc. on its trade secret misappropriation claim against a former employee. The appeals court found that Hercules demonstrated irreparable harm by citing evidence that the employee had already divulged proprietary information in contravention to the parties’ nondisclosure agreement.
