A federal district court in California denied e.l.f. Cosmetics Inc.'s motion to dismiss Benefit Cosmetics LLC’s trade dress claims relating to Benefit’s roller lash mascara, in this action for trademark infringement, trade dress infringement, false designation of origin, and unfair competition. According to the court, Benefit sufficiently alleged its trade dress is nonfunctional, has acquired secondary meaning, and stated with sufficient specificity the components of its alleged trade dress.
