The Federal Circuit denied MSN Laboratories Private Ltd.'s petition for a writ of mandamus reversing or vacating a federal district court in Virginia’s order transferring to the federal district of Delaware its action against Bioprojet Société Civile de Recherche seeking a declaration of non-infringement or invalidity of patents for monohydrochloride salt and treatment of various conditions with non-imidazole alkylamines histamine H3-receptor ligands. According to the appeals court, the district court plausibly concluded that judicial economy considerations favor transfer, and MSN didn’t show a clear and indisputable right to disturb the ruling.
