There’s no basis to vacate or amend the previous dismissal of this action involving Simio LLC’s patent directed at a system that improves the functioning and operation of a computer. Simio hasn’t demonstrated grounds warranting a motion to reconsider, and Simio doesn’t even claim, much less demonstrate, that its alleged “new and overlooked” facts were unavailable at the time it opposed FlexSim Software Products Inc.'s motion to dismiss. In addition, Simio hasn’t shown that there’s a need to correct clear error or manifest injustice or that granting leave to amend would be anything but futile. The case is Simio, LLC v.
