A federal district court in Illinois granted an e-commerce store’s motion to dismiss Bright Hand LLC’s claim for unfair competition stemming from the sale of allegedly infringing products to Illinois consumers. According to the court, Bright Hand didn’t allege any misconduct outside of the underlying patent infringement, didn’t plead a single source-identifying mark at issue, and sought to improperly apply trademark likelihood of confusion authorities to its traditional, utility-patent claims.
