Case: Patents & Trade Secrets/Attorneys’ Fees (D. Utah)

The District of Utah granted MarketDial Inc.’s motion for attorneys’ fees relating to Applied Predictive Technologies Inc.’s patent infringement and trade secret misappropriation claims. The court found that there was a complete lack of evidence supporting the trade secret misappropriation claims, and that they were objectively specious. And the court said that decision to aggressively litigate the issue constituted subjective misconduct, and awarded MarketDial over $2 million in attorneys’ fees.
