A federal district court in Texas denied Brain Frequency LLC’s motion for partial summary judgment on Wave Neuroscience Inc.'s action for infringement of patents for methods to provide Transcranial Magnetic Stimulation to improve a variety of brain disorders and cognitive functioning by targeting certain metrics obtained by an electroencephalogram. According to the court, Brain, a software company that only licenses its product to medical providers and disclaims any relation to the providers or their treatment, isn’t a related health care entity immunized from patent infringement liability for performance of a medical activity.
