A federal district court in Illinois granted in part and denied in part Stericycle Inc.'s motion for summary judgment of noninfringement on this action by Catilina Nominees Proprietary Ltd. and Daniels Sharpsmart Inc. for infringement of a patent for a container for the disposal of medical sharps and waste materials. The court granted Stericycle summary judgment with respect to patent infringement under the literal infringement and doctrine of equivalents theories for the commercialized design of Stericycle’s container, as well as for the testing and sample design pursuant to a doctrine of equivalents theory.
