A federal district court in California granted in part and denied in part Applied Materials Inc.'s motion for summary judgment of non-infringement in its action against Demaray LLC seeking a declaration relating to patents that concern a way to deposit thin films of materials onto a surface. According to the court, there are no genuine disputes that Applied’s products don’t literally infringe the patents, but Applied failed to show that prosecutorial estoppel precludes Demaray from asserting infringement under the doctrine of equivalents.
