Case: Patents/Summary Judgment (Fed. Cir.)

The Federal Circuit affirmed the decision of a federal district court in California granting AeroVironment Inc. summary judgment on two inventors’ action for infringement of a patent that pertains to a rotary wing vehicle with an elongated tubular backbone and a counter-rotating coaxial rotor system. The appeals court affirmed the district court’s determination that AeroVironment’s affirmative defense covered all of its alleged infringing activities, as well as its denial of AeroVironment’s motion for attorneys’ fees.
