Case: Patents/Summary Judgment (Fed. Cir.)

The Federal Circuit dismissed in part and affirmed in part the decision of the District of Delaware granting Shopify Inc. summary judgment of noninfringement of two Express Mobile Inc. patents, and granting Shopify judgment as a matter of law as to asserted claims of three patents. The appeals court concluded that this case is moot as to the claims determined to be unpatentable in proceedings before the Patent Trial and Appeal Board that the Federal Circuit affirmed, and that the district court didn’t err in granting summary judgment of noninfringement.
