The district court of Massachusetts denied in part Maquet Cardiovascular LLC’s motion for partial summary judgment on Abiomed Inc., Abiomed R&D Inc., and Abiomed Europe GmbH’s defenses in this action for infringement of a patent that discloses systems for intravascular blood pumps. The court denied as moot Maquet’s motion for partial summary judgment of no invalidity as to Abiomed’s defense of invalidity based on the lack of written description of a claim term, granted its motion as to Abiomed’s defense of invaliditty based on indefiniteness of two claim terms, and otherwise denied the motion.
