The Federal Circuit reversed and remanded the decision of a federal district court in California dismissing Medtronic Ireland Manufacturing Unlimited Co.'s counterclaims of patent infringement against Recor Medical Inc. for lack of constitutional standing, in this action seeking a declaratory judgment of patent invalidity and non-infringement. According to the appeals court, Medtronic Ireland retained at least an exclusionary right sufficient to establish standing.
