The Federal Circuit affirmed the decision of a federal district court in Arkansas that claims of Enviro Tech Chemical Services Inc.'s patent directed to methods for treating poultry during processing for increasing the weight of the poultry using peracetic acid are invalid as indefinite, in an infringement action against Safe Foods Corp. The appeals court said that the claim term “about” is indefinite, rendering the asserted claims invalid.
