The Federal Circuit affirmed the decision of a federal district court in Ohio denying an inventor and Spota LLC relief from a previously-affirmed sanctions award in this action against ShieldMark Inc., Crown Equipment Corp., and Advanced Plastics Inc. for infringement of a patent directed to floor marking tape used in industrial facilities. The appeals court granted the motion to the extent the district court’s decision is summarily affirmed, and said that the appeal isn’t so wholly frivolous that further sanctions should be imposed.
