A federal district court in Texas granted CSI Inc.'s motion to dismiss mCom IP LLC’s action for infringement of a patent that relates to novel and improved systems and methods for constructing a unified banking system. The court said that the Patent Trial and Appeal Board canceled the claims as unpatentable as obvious over prior art in an inter partes review proceeding, and that mCom didn’t seek leave to serve amended infringement contentions that include non-canceled claims.
