The Federal Circuit denied FullView Inc.'s request for permission to appeal orders of a federal district court in California that determined some asserted patent claims are invalid due to unpatentable subject matter and that excluded FullView’s expert’s testimony on damages, in this patent infringement action against Polycom Inc. The appeals court found no controlling question of law as to which there is substantial ground for difference of opinion and for which an immediate appeal may materially advance the ultimate termination of the litigation.
