The Federal Circuit affirmed the decision of a federal district court in California denying Ascendis Pharma Inc. a stay in this action seeking a declaratory judgment of non-infringement of BioMarin Pharmaceutical Inc.'s patents related to treatments for children with achondroplasia. The appeals court said that the district court didn’t err by denying Ascendis’s motion for a mandatory stay pending disposition of related proceedings before the International Trade Commission.
