The Federal Circuit affirmed the decision of the Court of Federal Claims dismissing an individual’s complaint alleging that the U.S., through the Department of Homeland Security, caused cell phone manufacturers to produce devices that infringe on one or more of his patents. The appeals court said that the court correctly found that the allegations are outside the six-year limitations period and that it didn’t have jurisdiction over the patent-infringement-based takings claim.
