The Federal Circuit denied Cambridge Industries USA Inc.'s petition for a writ of mandamus directing the U.S. PTO to reconsider its non-institution decisions of Applied Optoelectronics Inc.’s patents concerning optoelectronics modules. The court said that Cambridge failed to show a clear and indisputable right to the relief requested, given the limits on its review of the PTO’s decision to deny institution.
