The Federal Circuit denied SAP America Inc.'s petition for a writ of mandamus after the then-acting director of the PTO denied its petition for inter partes review of Cyandia Inc.'s patents. The court said that SAP didn’t show a clear and indisputable right to relief in light of the director’s finding that IPR would be an inefficient use of resources given the progress of parallel district court proceedings between the parties involving the same patent.
