The Federal Circuit denied an individual’s petition for a writ of mandamus seeking to set aside a federal district court in New York’s order referring issues related to Google LLC’s affirmative defenses to a magistrate judge in this patent infringement action. The appeals court held that the individual failed to demonstrate the inadequacy of an appeal following final judgment, failed to identify any legal issues over which there is considerable litigation producing disparate results, and didn’t show a clear and indisputable right to relief.
