The District of New Jersey denied in part and reserved in part Deva Holding A.S.'s motion to dismiss Teva Branded Pharmaceutical Products R&D Inc., Teva Pharmaceuticals USA Inc., and Norton (Waterford) Ltd.'s action for infringement of patents for albuterol sulfate inhalation aerosol and a declaratory judgment of infringement. The court reserved the motion to dismiss the infringement claims during the pendency of an appeal in another case, and denied the motion to dismiss the declaratory judgment claims.
