The Federal Circuit dismissed in part and affirmed in part the decision of a federal district court in New York denying Sherman Speciality Inc. and Sherman Specialty LLC’s post-verdict motions for inventorship, invalidity, and non-infringement of Dynamite Marketing Inc.’s patent. The court dismissed Sherman’s appeal with respect to the correction of inventorship claim, affirmed the denial of Sherman’s post-verdict motions on invalidity and non-infringement, and affirmed the jury’s award for damages and the district court’s grant of Dynamite’s attorney’s fees.
