A federal district court in New York granted E. Mishan & Sons Inc. judgment on the pleadings on its action against Caraway Home Inc. seeking a declaratory judgment of non-infringement of a design patent that protects the ornamental design for a cookware lid, and Caraway’s counterclaim for design patent infringement. According to the court, Caraway can’t show that the claimed and accused designs appear substantially the same.
