A federal district court in California granted Capella Photonics Inc.'s motion to dismiss Finisar Corp.'s action seeking a declaratory judgment that Finisar and its customers haven’t infringed two patents for reconfigurable optical add-drop multiplexers with servo control and dynamic spectral power management capabilities. The court granted the motion to dismiss for lack of subject matter jurisdiction and dismissed the complaint with leave to amend. And the court ruled that Finisar isn’t entitled to a preliminary injunction and that the customer-suit exception to the first-to-file rule doesn’t apply.
