The Supreme Court reversed the Federal Circuit’s decision in Amarin Pharma, Inc.'s patent infringement action against Hikma Pharmaceuticals USA Inc., effectively granting Hikma’s motion to dismiss for failure to state a claim of induced infringement. The Court found that Amarin failed to plausibly allege that Hikma took “active steps” to encourage infringement of Amarin’s method-of-use patents for Vascepa’s cardiovascular indication, as Hikma’s statements were either legally required, standard practice, or too vague.
