A federal district court in New York denied T. Moriarty & Son’s motion to dismiss FloodBreak LLC’s action for directed and induced infringement of a patent for devices designed to prevent or mitigate flooding in subway systems. The court said that sales may occur at multiple points in time, that FloodBreak plausibly alleged post-issuance sales, and that the requirements for inducement of infringement were satisfied.
