Medical device company Cochlear Ltd. has shown good cause to amend its complaint alleging that Oticon Medical AB’s Ponto BHX implant infringed on Cochlear’s patent for a bone anchor fixture for a medical prosthesis. Cochlear seeks to add an allegation that Oiticon willfully infringed the patent and also requests increased damages. Oticon won’t undergo any undue prejudice as a result of this amendment, because Cochlear merely wants to add a heightened claim of the same infringement already alleged in the complaint.
