Some challenged claims of Atos LLC’s patent that describes detecting and analyzing states relating to the environment outside a portable device are unpatenable as obvious over prior art, the Patent Trial and Appeal Board determined, in an inter partes review by Allstate Insurance Company. The board held that some challenged claims are obvious over a textbook titled “An Introduction to Mechanics,” that describes determining roles and usages of a mobile device within a vehicle, and that relates to a terminal device for providing a context aware-based mobile service.
