The Patent Trial and Appeal Board held that challenged claims of UNM Rainforest Innovations’ patent that relates to bit allocation and interleaving for communication systems are unpatentable as obvious over or anticipated by prior art, in an inter partes review by Qualcomm Incorporated and ZyXEL Communications Corporation. According to the board, the challenged claims are obvious over or anticipated by various combinations of prior art, including prior art that discloses a transmitting/receiving apparatus and method for improving decoding performance at retransmission, and an interleave apparatus and method for preventing an increase in the number of retransmissions and improving throughput.
