The Federal Circuit affirmed in part and reversed and remanded in part the decision of the Patent Trial and Appeal Board finding that some claims of Document Security Systems Inc.'s patent for an optical device with a light emitting diode die are unpatentable as obvious over prior art, in an inter partes review by Nichia Corporation. The court reversed and remanded as to five claims that the board said aren’t unpatentable, because Nichia proved that an electrical claim limitation is disclosed in prior art, and it affirmed as to all other claims.
