The Federal Circuit affirmed the decision of the Patent Trial and Appeal Board that claims of Pictometry International Corporation’s patent that discloses a process that may be useful as part of a process for measuring a roof using aerial imagery are unpatentable as obvious over prior art, in an inter partes review by Roofr Inc. The court rejected Pictometry’s argument that prior art references failed to teach the patent’s “user-acceptance” temporal requirements.
