The Federal Circuit affirmed the decision of the Patent Trial and Appeal Board that Apple Inc. didn’t show that challenged claims of Gesture Technology Partners LLC’s patent for methods and apparatuses to enable rapid TV camera and computer-based sensing in many practical applications are unpatentable as obvious over prior art, in inter partes reviews. The court said that substantial evidence supports the board’s finding that an asserted prior art reference fails to qualify as analogous art.
