The Federal Circuit vacated and remanded the decision of the Patent Trial and Appeal Board that Apple Inc. didn’t prove by a preponderance of the evidence that challenged claims of Smart Mobile Technologies LLC’s patent that discloses a portable and wireless network box are unpatentable as obvious over prior art. The court determined that the board erred by failing to consider Apple Inc.’s evidence under a new claim construction.
