The District of Delaware denied Ecolab Inc. and Ecolab USA Inc.'s motion for leave to file a second amended complaint in their action seeking a declaratory judgment that Ecolab could enforce Deb IP Limited’s patents for hand sanitizer and skin care products, and alleging breach of the parties’ license agreement. The court said that Ecolab failed to state claims for a declaratory judgment of enforcement, breach of license agreement, breach of implied covenant of truthfulness, and breach of contract by failure to cooperate with Ecolab’s enforcement efforts.
