The Federal Circuit reversed and remanded the decision of a federal district court in California dismissing for lack of personal jurisdiction Apple Inc.'s complaint for declaratory judgment of noninfringement against Zipit Wireless Inc. Apple sought a declaratory judgment that it didn’t infringe Zipit’s patents on technology that allows devices to send and receive messages instantly over Wi-Fi. According to the Federal Circuit, Zipit has the requisite minimum contacts with California and Zipit didn’t present a compelling case that the presence of some other considerations would render jurisdiction unreasonable.
