The Federal Circuit affirmed the decision of a federal district court in Texas dismissing for lack of subject matter jurisdiction this action by patent inventors challenging the PTO’s denial of micro-entity status for their applications. The appeals court said that the inventors’ assignment obligation representations meant they had not shown the injury necessary to establish standing.
