The Federal Circuit vacated and remanded decisions of the District of Massachusetts in Rasmussen Instruments LLC’s action against DePuy Synthes Products Inc. and DePuy Synthes Sales Inc. for infringement of patents directed to instruments used during surgical installation of a knee replacement implant. According to the appeals court, Rasmussen Instruments didn’t own either patent at the time it filed suit, so the court lacks subject matter jurisdiction.
