The Federal Circuit dismissed AlexSam Inc.'s appeal of a decision of a federal district court granting Simon Property Group LP and Blackhawk Network Inc. summary judgment of non-infringement on this patent infringement action. The appeals court said that Simon and Blackhawk’s sanctions and fees motions are still pending, so the district court’s order as to those issues is not yet final and appealable.
