Case: Patents/JMOL (Fed. Cir.)

Oct. 17, 2023, 12:33 PM UTC

The Federal Circuit affirmed in part, reversed in part, vacated in part, and remanded the decision of a federal district court in California granting JMOL of nonobviousness, and denying Chilisin Electronics Corp.'s motions for JMOL regarding non-infringement and damages and to exclude Cyntec’s damages expert testimony as speculative, in Cyntec Company Ltd.'s action for infringement of patents that teach that mixing magnetic powders generally requires effective annealing. The appeals court affirmed the judgment of infringement, reversed the JMOL for nonobviousness and the denial of Chilisin’s motion to exclude damages expert testimony, and vacated and remanded the lost profits award.
