The Federal Circuit vacated and remanded the decision of a federal district court in Pennsylvania granting FMC Corp. a preliminary injunction barring Sharda USA LLC from importing, marketing, selling, or distributing its insecticide, in FMC’s action for infringement of patents that propose novel insecticidal compositions comprising bifenthrin and a cyano-pyrethroid that purportedly exhibit unexpected insecticidal activity. The appeals court found that the district court abused its discretion by relying on an erroneous claim construction and clearly erroneous factual findings in its analysis of anticipation and obviousness.
