The First Circuit vacated and remanded the order of the district of Massachusetts preliminarily enjoining Fii USA Inc.'s China International Economic and Trade Arbitration Commission arbitration in this action by Vicor Corporation alleging patent infringement by importing knock-off products into the U.S. The appeals court said that the plain text of 28 U.S.C. § 1659 supports Fii’s claim that it was entitled to a stay.
