The Federal Circuit affirmed the decision of a federal district court in Georgia granting Coca-Cola Co. summary judgment of non-infringement of Rothschild Connected Devices Innovations LLC’s patent that discloses a system and method for creating a personalized consumer product. The appeals court affirmed the district court’s finding that the claimed communication module must be configured to perform its steps in the order in which they are written, and that Coca-Cola thus didn’t literally infringe via its accused dispensers.
