The Federal Circuit affirmed in part and vacated and remanded in part decisions of the Patent Trial and Appeal Board that some challenged claims of OsteoMed’s patents that claim systems for securing bones together across a joint using bone plates are unpatentable, in inter partes reviews by Stryker Corp. The court said that substantial evidence doesn’t support the board’s finding that a prior art reference didn’t anticipate the independent claims, and rejected OsteoMed’s challenge to holdings of unpatentability in its cross-appeal. because it affirmed the board’s relevant claim constructions.
