Case: Patents/Exceptional Case (D. Del.)

May 29, 2019, 3:00 PM UTC

Tupperware Brands Corp. did not demonstrate that its successful patent infringement case against Tangelo IP LLC was exceptional, thus warranting attorneys’ fees. The claims related to the abstract idea of using an identifier to allow a reader of a printed publication to access related information not in a printed publication and did not have an inventive concept. However, it was not objectively unreasonable for Tangelo IP to believe that the patent was valid. The case is Tangelo IP, LLC v. Tupperware Brands Corp., D. Del., 18-cv-692-RGA, 5/28/19.
