A federal district court in Texas granted in part and denied in part Lennox International Inc.'s motion to dismiss Rosen Technologies LLC’s action for infringement of patents for programmable thermostats with location or remote correspondents. The court said that Rosen stated a claim with respect to the eligibility of three of the asserted patents, because there are plausible factual allegations that the claims aren’t directed to abstract ideas or do include inventive concepts. But the court said that Rosen hasn’t sufficiently stated a claim of direct infringement of one patent.
