A U.S. magistrate judge’s report and recommendation in ZapFraud Inc.'s action against Barracuda Networks Inc. for infringement of ZapFraud’s method for detecting phishing attempts was adopted in part and vacated in part by a federal district court in Delaware. The magistrate judge recommended that the court grant in part and deny in part Barracuda’s motion to dismiss the claims of induced infringement, contributory infringement, and enhanced damages for willful infringement. The court dismissed ZapFraud’s claims for post-suit indirect infringement and willfulness-based enhanced damages.
