The Federal Circuit affirmed the decision of the Patent Trial and Appeal Board that some claims of Viasat Inc.'s patent that discloses methods, systems, and devices for forward error correction in flash memory aren’t unpatentable as anticipated by and obvious over prior art, in an inter partes review by Kioxia Corporation and Kioxia America Inc. The court said that the board’s claim construction wasn’t erroneous, and found that the appeal is moot as to some claims, which were canceled after being found unpatentable in a separate IPR proceeding.
